Nous faisons en fait une distinction entre: d'une part, les problèmes de violences conjugales au sein du couple; d'autre part, les relations parents-enfants et l'organisation de celles-ci lorsqu'il y a des violences conjugales. Cette distinction permet d'aborder la question des enfants en faisant abstraction des conflits du couple. Les juges eux-mêmes traitent ces deux questions de façon distincte pour éviter que les discussions de couple n'interfèrent avec l'intérêt de l'enfant. Il y a toutefois un lien inévitable au sein d'une famille entre la relation de couple et la relation parent-enfant. Les violences conjugales pourront en effet avoir une incidence sur la manière dont seront gérées les relations parents-enfants." Increasingly, children are being treated as active participants in the processes and decisions that affect them. In cases of divorce and separation, especially where parental relationships are conflicted, the accepted wisdom in the UK for many years has been for children to be protected rather than empowered. More recently, practitioners, policy makers and researchers have looked for ways to involve children, although the ‘welfare’ of the child has remained paramount. In this context, the question of how to ensure that wishes and feelings expressed are those that authentically belong to the child, rather than to their parent, sibling or other, has achieved a new significance. This article presents findings from recent research to illustrate how the tension between protection and empowerment is being played out in this aspect of welfare report enquiries carried out by CAFCASS (Children and Family Court Advisory and Support Service) private law practitioners." Several organisation and client-related factors have been associated with reduced job satisfaction among social workers. Scant attention has been given to work?family conflict as a potential contributor despite growing evidence of its detrimental impact on the job satisfaction of varied sample groups of working men and women. The present study examined the impact of three forms of work-to-family conflict (WFC) and family-to-work conflict (FWC): Time, Behaviour and Strain, on job satisfaction of social workers in Australia. Data were gathered via an online survey from members of the Australian Association of Social Workers which yielded 439 usable data. Hierarchical multiple regression analyses showed that, in the direction of work-to-family conflict, WFC-Time and WFC-Strain were significant predictors of reduced job satisfaction. In the direction of family-to-work conflict, FWC-Behaviour significantly predicted reduced job satisfaction. These findings have implications for social work workforce planning and retention of social workers, and it emphasises the importance to have organisational policies that enhance the ability for social workers to manage their work and family commitments responsibly."
